01. Introduction
Welcome to Castly ("Platform"). These Terms of Service constitute a legally binding agreement between you and Castly. By accessing, browsing, or using our Platform, you expressly agree to comply with and be bound by these terms.
Castly is an exclusive digital infrastructure designed for 1:64 scale model collectors. We provide the technological framework that empowers independent diecast garages (sellers) to showcase their inventory and connect directly with collectors (buyers).
02. Platform as an Intermediary
Under the strict provisions of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Consumer Protection (E-Commerce) Rules, 2020 of India, Castly operates explicitly and exclusively as an "Intermediary" and an "E-Commerce Marketplace Entity."
- Castly merely provides the technological platform that facilitates discovery and transactions between independent third-party sellers and buyers.
- Castly does not own, sell, resell, manufacture, furnish, or directly provide any of the inventory listed on the Platform.
- All commercial and contractual terms—including pricing, shipping costs, payment methods, delivery timelines, returns, refunds, and warranties—are offered by and agreed to directly between the buyer and the respective seller.
- Castly shall not be held responsible or liable for any non-performance, breach of contract, or disputes regarding the quality, authenticity, or delivery of products.
03. Payments & Financial Transactions
Castly handles absolutely no payments on behalf of sellers or buyers.
To maintain complete transparency and decentralization, the Platform does not hold, process, or route buyer funds. When a buyer makes a purchase, the payment is processed and credited directly to the seller's configured payment gateway or UPI ID.
Because Castly does not collect or hold transaction funds at any point:
- We cannot issue refunds directly. All refund requests must be initiated with and approved by the specific seller you transacted with.
- Financial disputes must be resolved directly between the buyer, the seller, and the involved payment gateway provider or bank.
- Buyers are strongly advised to review the specific "Refund & Return Policy" of the individual garage before completing any transaction.
04. User Obligations
For Buyers: You agree to provide accurate shipping and contact information. You acknowledge that you are purchasing directly from an independent seller and agree to abide by that specific seller's store policies.
For Sellers: You agree to represent your inventory accurately, fulfill orders promptly, and clearly display your shipping, return, and privacy policies using the tools provided in your dashboard. You bear full legal and financial responsibility for the products you sell and the payments you receive.
05. Grievance Redressal Mechanism
In strict accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Consumer Protection (E-Commerce) Rules, 2020, Castly has appointed a Grievance Officer to address concerns related to the platform infrastructure.
